I'm not perfect....but I have Common fucking sense! It's the @fit culture now that people try to out do each other with crazier and crazier photos until they actually kill them selves or someone else...The photo is not funny, it's idiotic! Whats next...Wall balls with the baby

1. No, i have never held 135 pounds over my kids head. First becasue i would not endanger their lives. Second 135 is a warmup weight..for me at least.

2. These are not great people and not great parents. Was Micheal jackson a great parent when he dangled his son over the balcony edge?

Crossfit is a family activity. Bring your kids along from an early age and get them involved. That baby is a Crossfit Games future champion. No question about it.

This guy may have destroyed his business with that one photo. He and his wife have already called Lizard Breath to have the photo taken down from the affiliate site. But, get this, she can't "unpublish" it because that's not the @fit way !
If that was the couch, I bet it would come down in a New York minute.

I'll try to add a little to this. I know the jurisdiction, the judges, and the firm who defended teh box.

First of all, this case was filed in district court in Colin County, Texas, then taken up before the Texas Court of Appeals--Dallas district. Without knowing anything about the lawsuit, you can assume the plaintiff is going to fucked. That's how it is here.

Second, it sounds like Quintana is a fat black woman. This does not bode well for her in front of a Colin County jury.

Third, it looks like Quintana's lawyer is decent. Looking at the docket sheet, he got most of what he needed. He fell apart a bit at the end. As a plaintiff's lawyer, you don't want to agree to a scheduling order (setting dates and deadlines) and then ask for more time less than a week before trial. Then he screwed up his appellate brief the first time around and nearly got thrown out. That might be a payment issue with his client, though.

Now for the nuts and bolts. At common law, you can't consent to someone's potential negligence. But Texas ain't the common law. A gym provides fair notice and can be insulated from negligence if the items in the waiver are 1) "conspicuous" (big letter, caps, etc.) and 2) contain an express statement that the gym clearly intends to be released from potential negligence. This is not the same thing as fair notice of potential injury or specific acts of negligence. Basically you could write, "Our employees are @F certified, which means they don't know shit and will possibly injure, maim, or kill you. You agree, by your signature, that you cannot sue us for the negligence of these untrained assholes." That would hold up. Seriously.

So, I've been told that in his presentation to US Military Brass last week that part of Couch's sales pitch was that @fit has had trainees die from rhabdo.

Speaking from the knowledge and perspective of one who was ACTUALLY THERE when the photo was taken, it is quite clear, and very unfortunate, that the context of, and the manner in which, the photo was taken has been severely misunderstood and grossly scrutinized.

The fact that such harsh judgements and blatant character assassinations have been made without knowledge of the true facts of the captured moment is quite lamentable.
