No, No, No....@Fit is a mental and spiritual thing!! It's about taking your body and mind to a place that most people are scared to visit and prefer not to feel! Here's a prime example: what if you were sitting next to God in Heaven and he said "I'll give you a chance to go sit with the Devil for 90 seconds and experience some real eternal pain and then I'll bring you back to me in Heaven" How many people would be willing to leave the comfort of Heaven (even for only 90 seconds) just to see what some real eternal demonic pain feels like? NOT MANY... Well that's what @Fit is, I'm constantly scared to go there, constantly scared of really pushing myself to another level. Constantly scared of a higher level of pain
He really shouldn't be so scared. I haven't seen cultists like this since I was doing Aikido in the early '90s.

I have had more than a few conversations with Greg Glassman about this topic and I am sure that he would not agree with that at all. I think he was more than clear about that with me. In fact, his famous posts about my lack of whatever was targeted at my faith tradition.

I think one of the things I notice in my work with crossfit affiliates, I teach and coach at them every week now, is the disconnect between the founders, foundations and basics of Crossfit and the owners of the facilities/affiliates/boxes. There will be a white board and kbells and O bars, but it is usually a gym like I grew up around.

If Crossfit is providing spiritual guidance for its membership, it certainly was not part of the original vision.

I think it's a nomenclature issue Dan, they are confusing distilled spirits with spirituality.

He may disagree in conversation, but he has gone to great lengths to set himself up as a spiritual founder/leader of this fitness cult. Even now he is preparing to martyr himself for the cause.

couch, you deserve it. For all the "defining" of fitness you think you did, you didn't define shit as to what @F really means (neither did Saran's copyright defense article), and the courts will obviously come to this conclusion as well.

Just wait for the precedent to be set.

Or, they will be forced to define it so specifically that none of the gyms who wised up will be able to call themselves @F anymore just because they have barbells and gymnastic rings in the same room.

Noticed at Dick's Sporting Goods that all the Reebok advertising said THE SPORT OF FITNESS HAS ARRIVED, but made no references to Crossfit at all.

So - planning to cut out the middle man down the road? Also noticed that the men's section was one rack and the women's was huge. Guess that's where the money is when it gets Zumba-ed.

Hi Everyone

Some of you wrote to me to know what was behind the removal of images on Facebook and my blog from The Games. I included some explanation in this blog. I know it is a bit long and you are use to images but bare with me there are images below J

About a 2 weeks ago I have been getting a series of communication with CROFFIT INC Headquarters about a series of Trademarks and Copyright Infringements. When this started I immediately connected with them to understand what was at the bottom of this as I seem to get conflicting information on the matter. It seems that what started all these inquiries was my posting of MY GAMES photography photo book and album on social media.

According to their rules: (This is cut and paste from an email they sent me)

“....your taking pictures of The Games at the Home Depot Center and proposed use is both a violation of the contract in which you agreed to as a ticket holder to the event and a violation of our copyright. The ticket that you used to enter The Games included a contract, which was printed on the back. The contract is binding on you as a holder of the ticket, regardless of whether you purchased it or it was given to you. Applicable language states:

The Holder acknowledges and agrees that any commercial or other unauthorized use of any transmission, picture, film, tape, writing, drawing, or other depiction or description of the Event or any of the teams, players, performers or other participants therein, or any of their respective marks or logos is prohibited without prior written approval of The Home Depot Center and the teams, players, performers, promoters or other participants involved in the Event, as applicable. The Holder further agrees that the Holder will not transmit or aid in transmitting any description, account, picture or reproduction of the Event or any portion thereof without prior written approval of The Home Depot Center and the teams, players, performers, promoters or other participants involved in the Event, as applicable.


As a ticket holder, you agreed not to use pictures or film from The Games. Further, you agreed not to transmit pictures or films from The Games. Printing and distributing a photobook or individual photos with or without the CrossFit® trademark included is a violation of this contract and is legally actionable. …”



As a conclusion:

· The taking of any photos by anyone at The Games is both a violation of the contract he or she agreed to as a ticket holder and a violation of our copyright. Therefore, all pictures you took from The Games must be removed from your Facebook account, blog and company webpage, and may not be distributed in any manner in print.

· The use of our registered trademark (CrossFit®) is a trademark when it is used in any way that may generate commerce. You may not use our trademark in connection with a Facebook account, blog or company website that may drive activity for your business.

First and foremost I did not read the fine print behind my ticket and can admit to that. I have attended countless of professional events and as you get on the site there are signs such as NO CAMERA EVERYWHERE in addition to random bag searches. What somewhat mislead me in Carson was that as I passed the gates my bag was searched but and I never hid my camera it was in plain site. In addition to seeing so many people like myself in the stands everywhere with 20-300m++ zoom … I even exchanged note with folks who have been attending for 2- 3 years in a row and shared images from previous years with me. I had conversation with members of the Crossfit Inc staff on site who boasted that the games was a great opportunity for fans and enthusiasts to take great photographs. Nothing made me even think twice about checking to see if there was an issue in taking images at this event. In addition when I returned home and saw thousands of images on social media from people who attended the event. Therefore I was quite surprise to hear about this rule. Nevertheless I complied to the rules as I respect trademarks and copyright laws.



What I am having a hard time understanding is that I feel like I have been called out “singled out” in a crowd of thousands. I have contacted photographers who have posted images about the games and that have tagged many athletes on Facebook in the public arena for everyone to see. So far I have not met one who was asked to take their images down Facebook. Maybe it’s my luck …. Many claim to not being aware of this rule at all. In addition & to my surprise some are tagging their apparel gear, supplement, product company site directly on the post which implies commercial interest and traffic to their site.



According to this rule anyone who is showing imagery on Facebook & twitter obviously tagging athletes should be contacted. How can they pick and chose who they go after in a public arena. The person that I was discussing with at the HQ mentioned that the Crossfit Inc does not have the financials to go after everyone but under some basis I was defined as being more of a threat to their asset that is why I am on their “WATCH LIST? .. I still am not clear as to why I am being singled out of such a large arena with so many images posted. The “quality of my work” should not be a factor as the rule does not say pictures of a certain quality or pictures with iphones or point and shoots allowed… There is no room for interpretation a picture is a picture. In addition I feel that is it unfair to ask me to report people infringing when they are out in the open for everyone one to see.

How transparent is the application of this rule within the community? I would really like some answers on that and definitely want to hear from other photographers out there who have been through a similar situation…

I am still waiting for answers and will see how all this unfold. Someone asked me if I was worried about burning bridges by posting about this. It would be a disrespect to myself to stay quiet and put this under the rug. At the end of the day I have been nothing but respectful & cooperative with Crossfit Inc from the beginning about this situation. My intention was never to violate their Trademarks and Copyrights I was simply unaware of their rules. At the end of the day though I feel that there is some prejudice to me and that is what I am having an issue it. If that burns bridge ah well ..i’ll just learn how to swim. Everytime I go on Facebook and see thousands of images for everyone to see tagging Athletes in the open I feel that prejudice.

All to say that this situation has been quite disappointing at so many levels. The saddest part was to tell athletes to remove images they are using as profile pictures. At the end of the day I do what I do because of the love of it. Many of these athletes are some of my greatest source of inspiration so when I shoot and share this work and they ask for a print as a souvenir… it is my pleasure. I will also not apologize for the quality of my work either and will leave this comment at that for now. So this is the story that caused all of this removal. Again I apologize for this situation definitely a lesson learned.
