Attorneys representing 14 mothers of students at Miramonte Elementary School announced Tuesday the filing of a lawsuit that alleges the school district did not protect their children from a teacher accused of lewd acts involving children.

The lawsuit claims the Los Angeles Unified School District was negligent in the case of former teacher Mark Berndt, charged with lewd acts involving at least 20 children at the school.

Berndt was arrested in January.

The lawsuit, filed Tuesday morning, claims the children were sexually abused by Berndt between 2002 and 2011, and that the LAUSD "was negligent and did not protect their children from sexual abuses; and that the Los Angeles Unified School District completely ignored previous complaints," according to a statement from attorney Luis A. Carrillo.

The Los Angeles Unified School District board on Tuesday fired Miramonte Elementary School teacher Martin Bernard Springer just hours after he was formally charged with three felony counts of lewd acts upon a girl under age 14, a school spokesman said.

Springer, 49, of Alhambra, California, has 30 days to appeal his firing, school spokesman Tom Waldman said.

Springer pleaded not guilty late Tuesday afternoon in a Los Angeles County court to three felony counts of lewd acts on a child over three months in 2009.

The judge set his bail at $300,000 on the condition that Springer stay more than 250 feet away from witnesses and alleged victims, stay more than 100 feet away from any school or facility with children and be with an adult supervisor when he's around children.

Springer's preliminary hearing is scheduled for February 16.

Springer was the second teacher at Miramonte charged with lewd conduct with pupils.

The lawyer for the mother of a girl who was allegedly abused by a Miramonte Elementary School teacher announced Friday the family has filed a claim in court against the teacher and the school district, alleging “a massive cover-up” that allowed abusive behavior for two decades.

Attorney Brian Claypool accused Miramonte teachers of escorting young female students to the empty classroom of Mark Henry Berndt afterschool so he could “carry out all of his sordid activities on these kids.”

“He would say, ‘Hey that little girl over there looks pretty,’” Claypool said during a noontime news conference outside Miramonte Elementary School. ”Why don’t you bring those little girls over to my class over here.

“That is horrible, horrific, reprehensible and that puts this school on notice that they have other individuals working in that school who have aided and abetted Mr. Berndt.”

The claim - a precursor to a lawsuit - seeks damages for emotional distress and calls on the Los Angeles Sheriff’s Department to broaden its investigation into the the school going back 20 years, after a student reportedly made the first complaint about Berndt’s alleged inappropriate behavior.

California watchdog Joseph Perkins reports on the California’s teachers unions’ triumph of defeating SB 1530, a measure aimed at ridding schools of teachers accused of inappropriate behavior with students:

After passage in the state Senate by a 33-4 bipartisan majority, the Assembly Education Committee bowed this week to the state’s all-too-powerful teachers unions, rejecting a bill authored by Padilla, D-Van Nuys, that would have expedited the dismissal process for teachers accused of sex, violence or drug offenses involving children.

The measure, SB 1530, cleared the Senate by a 33-4 bipartisan majority (a rarity inSacramento). However, intense lobbying by the California Teachers Association and United Teachers Los Angeles resulted in Padilla’s bill falling one vote shy of approval by the Assembly Ed Committee, killing the much-needed reform for this year, if not forever.

Padilla crafted his bill in the wake of several scandalous incidents this past school year in which students were sexually abused by teachers. Perhaps the most notorious case involved Mark Berndt, a third-grade teacher at Miramonte Elementary School in Los Angeles, who was accused of 23 lewd acts against children.

After being fired by the Los Angeles Unified School District, Berndt filed an appeal. While it is likely the school district ultimately would have prevailed, it would have done so only after expending considerable time and money. So the school district actually paid the accused child molester $40,000 to drop his appeal.

A teacher at a South ESC middle school was accused by a student of putting his hands around her waist, and caressing their lips and buttocks. Two other girls in different classes said they'd also been victimized. The teacher had been warned in 2005 and 2007 not to engage in this type of behavior. He was fired in December 2012.
Parents complained that a male teacher at a North ESC middle school had asked girls in his class to wear a particular Halloween costume because he wanted to photograph them. Students told investigators that the teacher, born in 1963, rubbed their shoulders and backs, and had them write poems about their buttocks. The teacher had been warned of inappropriate behavior dating back to 1997. He was fired in December.
A veteran teacher at a West ESC elementary school was fired in November 2012, a month after a student reported that he'd been hit hard enough to cause pain. The investigation revealed complaints dating back to 1999 by boys and girls who said the teacher lost his temper and threw objects at them, and touched them and himself inappropriately in the classroom.
Parents reported that a male teacher at an East ESC elementary school kissed their child, and photographed and videotaped the youngster without permission. The teacher, born in 1968, had complaints in his file about similar behavior dating back to 2000. He was fired in December.

Props to LAUSD for finally doing the right thing.
The personnel files stretched the length of the 15-foot conference table in Superintendent John Deasy's office, a chronicle of the corporal punishment, verbal and physical abuse and sexual misconduct reported in the classrooms of the Los Angeles Unified School District.

Cuts and bruises. Curses and racial slurs. Caresses and pornography.

In the past, the misdeeds detailed in the teachers' files would likely have earned the offender a disciplinary memo, maybe a week's suspension, perhaps a transfer to another school.

Today, they're grounds for firing.

Under the zero-tolerance policy that Deasy enacted after the Miramonte Elementary sex-abuse scandal erupted in February 2012, the school board has voted to dismiss more than 100 teachers for misconduct, and accepted the resignations of at least 200 others who were about to be terminated. Nearly 300 additional teachers accused of inappropriate behavior remain "housed" in administrative offices while officials investigate the complaints.

I can only imagine teachers unions are full of pedophiles and people who hate kids, given their behavior in these situations
