Phony claims of racism are nothing new.
Women and people of color earn a lower income for the same work. People of color pay more for homes and cars. Employers are less likely to offer job interviews to people with “black-sounding” names. Teachers are less likely to recommend black and Latino students for gifted education and more likely to recommend them for special education, than white students with identical test scores. Doctors are less likely to offer pain management and necessary testing for people of color. Environmental hazards are greater in communities of color. Poor women don’t have equal or adequate access to reproductive health care.

Holy shit that is disingenuous. The vast majority of criminal defendants (prob +95%) are sentenced via a guilty plea and plea agreement indicating sentence. Judges rarely deviate from the agreement. Moreover, many guilty pleas do not reflect the underlying facts. So, in essence, these pleas and sentences are the result of negotiations btwn prosecutors and defense attys (mostly pd's). It really is one of the most dishonest and slanted things I have ever read from the NYT.

No. I read the editorial and the article. That is how I knew what they were doing. Disparate Impact arguments mean one cannot show causation. Use that as your heuristic and you won't go far wrong.
If one reads the article carefully, one notices they do not lay blame anywhere specifically: not the judges, not the pds and not the DAs. They imply strongly that the judges are to blame. But if you parse the argument, they admit sentencing decisions are made before they see the case, but sort of argue that judges have the power of mercy so they are to blame because they didn't sentence the defendants to lesser sentences than their own attorney advocated for them.
The blame is on "the system" and how it is "racist". But like I said it is all disparate impact reasoning: blacks get more time therefore racism. Not necessarily so, and they can't point to any actually racist decisionmaking or even racism.
The system isn't racist in the way they imply. It isn't really racist at all. It is unfair and unjust but not in a racist way. There aren't enough PDs to go around is the main issue. And even if that got corrected, it wouldn't change the discrepancy from the racial perspective. It would just depress sentencing across the board.
