This is the equivalent of a commercial celebrity sex tape where the subject pretends to object to its release, but the law states that it couldn't have been sold in the first place unless the participants gave signed permission to the distributors.

2) there is no appropriation (you're not using this for trade),
3) there is no right to privacy (this is waived because she i. ordinarily seeks out publicity and ii. published the photos herself),
4) there are no fair use or copyright issues on cell phone pics that were taken voluntarily and published to a public, non-paying audience.

This wouldn't go anywhere. Even if everything went wrong and you ended up in court--which you wouldn't--exhibits 1-googol would be the pictures she posts of herself in her underwear. The first and last questions would be "so you took this picture/willingly/voluntarily/and texted it to several people you met at a fitness seminar?" Even Dale could defend this case.

Her regret (which is in doubt) after the fact does not create liability. Expectation of privacy is gone once you hit send. Sorry honey, you can't put the shit back in the horse.
