What is at issue initially was that the Sacketts argued that the Corp had no jurisdiction. The mode they chose determined the initial outcome. SCOTUS slapped EPA pretty hard for not allowing judicial review earlier in the process.
Ultimately, if the Sacketts had argued the facts, (is it wetland or not?) they wouldn't be here.

United States Environmental Protection Agency, 566 U.S. ___ (2012), is a United States Supreme Court case in which the Court held that the Clean Water Act is subject to the Administrative Procedure Act, which requires an appeals process for any ruling by a federal agency. The Court ruled that the availability of immediate judicial review of compliance orders issued by the United States Environmental Protection Agency is required.
This was decided mere months ago. I've said it before-- I'm not a lawyer. Explain it to me what I'm missing.

Having worked in that arena it for some time, I do agree with the EPA's stated position that an enforcement action is not a final agency decision....because it's not. I'm pleased to see that SCOTUS found the rule to be unfair becuase it may violate another act governing procedures, more process makes more leverage for me. But at the end of the day, the Sacketts made a semantic argument. In reality they would have been better off doing their due diligence and working using the procedure in place which is in all relevant ways a better process than an administrative appeal. At the end of the day the "victims" were idiots and will lose their house on the merits of the actual case.
