I work with contractors in NYC on a daily basis. In fact, I just completed an NYC Dept. of Buildings site safety management course. These sidewalk sheds (basically protective scaffolding to protect pedestrians from falling objects due to work overhead) have very strict requirements and the contractors pay out the ass for insurance. Any deviation from the standard whether on the contractors part or a third party leaves them subject to stiff fines. If it results in injury, it would leave the scaffolding contractor's, the general contractor's and the building owner's collective asses swinging in the breeze.
Even if the fucking hipsters were held liable, they are probably uninsured or so lightly insured that it is worthless to sue them and the injured party would go after the deepest pockets. There's already enough bullshit to get by in order to get things built in this town. Fuck these fucking worthless hipster fucking fucktards.

However, rather than run from these obstacles, we have continued to network and establish meaningful relationships with innovative BIDs, enthusiastic scaffolding contractors, and forward thinking developers.

The biggest risk Softwalks faces is exposure to liability. New York City is infamously litigious. A very small percentage of pedestrians slip, trip, fall, and run into things, and a smaller percentage decide to file lawsuits for compensation. Acknowledging these risks, we are consulting with specialists in streetscape design, volunteer lawyers, and are investing in event insurance for the pilot project.

I've never been in a city where something like this wouldn't interfere with the flow of foot traffic during busy hours. I can't imagine that local restaurants and coffee shops would be happy about it either. Sometimes the good idea fairy shouldn't be encouraged.

The flow of foot traffic is a fucking nightmare.
