I have requested no further action from pow network and navy seal experience. I know that once I give them the go ahead, they proceed with their protocol.

I just got off the phone with Don S. He has my former boss on audiotape claiming to be a SEAL. Fuck did Don sound pissed when he called me after. I guess my old boss hung up on him. Word of advice, never hang up on Don S. Side-note, I was served a cease and desist from my former employer this morning. This is going to get really ugly.

Same in the us. Truth is an absolute defense, and burden is on plaintiff to prove falsity

Well, I consulted with a big shot attourney (friend of one of my clients) when my asshole gym owner threatened to sue me for non-compete. The attourney (who I would have normally had to pay a shitload of money to) told me that non-competes are VERY hard to actually enforce. And to do so, the complainant would have to drop the cost of securing an attourney, which is usually around 25,000.

State of jurisdiction is Illinois and employers have lost 4 big cases at the appellate level over the past couple of years. I'm not to concerned at this point. The firm representing my former employer doesn't even have a labor or employment lawyer on staff. I think they are posturing.

Something you have on your side is "discovery" where you can query your former employer about all kinds of things under oath - including his alleged SEAL history. One would presume that he won't want that embarrassment as part of any court records.

A word to the wise, these things can take some unexpected and very expensive turns even when you are 100% right and prevail. I'm not a lawyer, just the voice of experience.

Other than in a few states, non-competes are reasonably easy to enforce so long as they are not for longer than, say, two years; don't cover a territory wider than the true competitive area; and the prohibited activity is what you did in your previous employment. You can defend against them, you can make it expensive, you can find leverage in different ways, but those are tough battles you'll need to fight if the employer comes after you.

Not an attorney, but I have spent (and continue to spend) a fuck ton of money on them. Litigation is something you really, really want to avoid if at all possible. The lawyers will get rich, and you'll burn hours of your life and too many long nights on it.

You could be on the side of the angels, but you have no idea what the outcome will be. Avoid the fight if possible.

I would agree that your former employer is just fucking with you. It costs really nothing in legal fees to have a letter basic employee cease and desist letter drawn up and mailed.

In CA and Washington State they can keep your from calling on or dealing with former customers & assigned territories for a period of 1-2 years. Non customers or territories are up for grabs.

I would suggest that you see if your new company will help you out in the legal department. Most non compete "Cease and Desist" letters are nothing more than (1) a reminder to abide by the terms of your non compete or (2) trying to get you out of an account you shouldn't be in anyways. However, some companies like fucking with former employees. I once had an employer try fucking with me over an non compete. My new employer stepped in and assigned my one of their in house attorney's. Once my old employer saw that an future games or litigation wasn't going to cast me anything they dropped the matter and left me a lone.
